Zorunlu Mecra İrtifak Hakkı

Abstract

Günümüz açısından değişen ve dönüşen teknoloji kapsamında taşınmazlar üzerinden yarar sağlanarak belirli bazı tesislerin kurulması gerekmektedir. Teknolojinin geliştirilmesi ve düzenlenebilmesi için yapılacak olan tesislerde mülkiyet hakkının kısıtlanması gerekliliği gündeme gelmektedir. Taşınmaz malikine ait olan mülkiyet hakkının yasal yollarla kısıtlaması gerekliliği mevcut olmakla birlikte AİHS tarafından ve ulusal hukuk açısından mülkiyetin kısıtlanmasına ilişkin maddeler düzenlenmiştir. AİHS ve diğer ulusal hukuk düzenlemeleri ile ayni hak olan ve herkese karşı ileri sürülebilen mülkiyet hakkının ne şartlar ve koşullarda ne tür haklar ile kısıtlanabileceğini belirlemiştir. Bizim açımızdan ise değişen teknoloji de mecranın kurulması mülkiyetin kısıtlanması açısından şartlar ve durumların neler olabileceğinin incelemeye alınmasının önemidir. Üç bölümden oluşan çalışmamız ilk bölümünde mecra irtifak hakkı kavramı hukuki niteliği ve çeşitleri incelemeye alınmış, ikinci bölümde ise zorunlu mecra irtifak hakkı şartları ve kurulması ve üçüncü bölümde ise zorunlu mecra irtifak hakkının, hükümleri, sona ermesi ve zorunlu mecranın güncel durumu ile uyuşmazlık halinde yargı süreci ele alınmıştır. Tezin yazım aşamalarında Avrupa İnsan Hakları Sözleşmesinden, 4721 sayılı Türk Medeni Kanunu, 6100 sayılı Hukuk Muhakemeleri Kanunu ve ayrıca mülga 743 sayılı Türk Medeni Kanunundan gerektiğinde ve de doktrindeki görüşler ile yargı kararlarından yararlanılmıştır. Within the scope of changing and transforming technology for today, some facilities should be established by benefiting from immovables. The facilities that will be built for developing technoglogy and regulation, must be restriction of ownership. There is The property right which belong of the immovable owner necessity of restring with legal ways and than articles restring of ownership these regulated by the ECHR and national law. The ECHR and other national regulations set out the conditions and conditions under which the limited property right, which is the same right and can be asserted against everyone, can be restricted. From our point of view, establish of the organization the changing technology is the importance of considering the conditions and conditions in terms of restricting ownership. Our thesis study consists of three parts. In the first part, the legal natüre and types of media easement concept are examined. In the second part, compulsory media easement conditions and it is establishment have been examined. In the third part, The provisions of the compulsory media easement right, the termination of this right and the judicial processin case of conflict with the current status of the compulsory media were examined. Legal sources used in writing the thesis; ECHR, Turkish Civil Code No. 4721, Law No 6100 on Civil Procedure, In addition, the opinions of the Turkish Civil Code No. 743 and the doctrines and judicial decisions were used.
