<title>Türk Ceza Hukukunda zorunluluk hali</title>
<link>http://hdl.handle.net/20.500.12416/5035</link>
<description>Türk Ceza Hukukunda zorunluluk hali
Çalışmamızda doktrindeki farklı görüşlere ve uygulamayı yansıtabilmek açısından çeşitli Yargıtay kararlarına yer verilerek, kurumun tarihçesi, hukuki esası ve koşulları incelenmiş; benzer kurumlarla karşılaştırma yapılmak suretiyle aralarındaki farklar ve mevzuatta yer alan özel düzenlemeler ortaya konulmaya çalışılmıştır.; In the understanding of modern criminal law, the principle of objective liability was abandoned and, instead, the principle of subjective liability where the factors affecting the crime are also taken into consideration has been adopted. Thus, on the basis of human psychology, the 'state of necessity' was regulated in order to allow an exemption from criminal sanctions under certain conditions for the crimes committed due to a threat imposed. The state of necessity requires the presence of a serious and absolute threat targeting a legally protected right, that is not intentionally caused. In addition, there must be neither any other ways to get protected nor any obligation to suffer from such threat. Finally, the perpetrator must have committed an act to an extent that offsets the threat in a way proportional between the severity of the threat and the subject and means used. The penal responsibility of the perpetrator would vanish only in case of the presence of all these conditions. The legal basis of the state of necessity is controversial in terms of the criminal law. Today, there are three different views available on the legal basis of the state of necessity. The first of these views takes the state of necessity as a reason for compliance with laws whereas the second view considers the state of necessity as a matter in extenuation (reasons for culpability) and the last view establishes the state of necessity as either a matter in extenuation or a reason for compliance with laws on a case by case basis. In our study, we examined the history, legal basis and conditions of the state of necessity by including the different views in the doctrine and various Supreme Court decisions in order to well reflect the practice, and put forward the differences between the state of necessity and other similar circumstances by making comparisons and the other specific regulations in the legislation.

<description>Suç işlemek amacıyla örgüt kurma suçu (TCK m.220)
Demirci, Ertan
Bu çalışmamızda da suç örgütlerinin yapısı, bu konudaki diğer ülke düzenlemeleri ve ülkemizde uygulanmakta olan yasal mevzuat hükümleri detaylı olarak incelenmiştir.; Organized crime groups can be defined as establishment who have a certain kind of hierarchy and commits indefinite number of crimes. Organized crime groups are not a type of establishment emerged recently, they acted as bandit, gang etc. in the early periods of history. Inrecently, with in the increase in technological developments and communication opportunities, criminal organisations have developed their activities and tools and have established a criminal network not only national but also international. Such activities of criminal organisations threat public order and peace, and couse anxiety and fear in public. Thesea ctivities are stated as crime in Article 220 of Turkish Penal Code. In this article, there are penalties for establisher, manager and members of the criminal organisations, contributer not member and propagandists. In this thesis study, we carry out a deep analysis into structure of organized crime groups, legislations in other countries and legislations of Turkey.

<link>http://hdl.handle.net/20.500.12416/2122</link>
<description>5237 sayılı Türk ceza kanununda hırsızlık suçu
Bununla birlikte çalışmamızda kanunda yapılan değişikliklere yer verilmiş, öğretideki hakim görüşlere ve karşıt görüşlere yer verilmiş, bu görüşler yüksek yargı içtihatları ile karşılaştırılmış, çalışmada da yer yer kanaatlerimize yer verilmiştir.; Nowadays, the spread of theft crime and punishment of the theft act is taken as the basis of the Turkish Criminal Code numbered 5237.
