Fikir ve sanat eserleri hukukunda lisans sözleşmesi

Abstract

Lisans sözleşmesi Fikir ve Sanat Eserleri Hukuku’nda özel olarak düzenlenen sözleşme tipleri arasında yer almamaktadır. Sözleşme, sağladığı yetkinin kapsamına göre, “basit lisans” ya da “tam lisans” olarak isimlendirilmektedir. Lisans sözleşmesi, genellikle her iki tarafa da borç yükleyen ve taraflar arasında sürekli borç ilişkisi kuran sui generis bir sözleşmedir. Lisans sözleşmesinde lisans veren taraf, gayri maddi hakkın kullanımını karşı tarafa devrederken, lisans alan taraf da kural olarak bir bedel ödeme yükümlülüğü altına girer. Lisans sözleşmesi, diğer sözleşmeleri de sona erdiren genel sebeplerle sona erebileceği gibi, Fikir ve Sanat Eserleri Kanunu’nda düzenlenen bir takım özel sebeplerle de sona erebilir.

License Agreements have not been defined as a special type of contract under Turkish Intellectual Property and Artistic Works Law. Contracts are named: “Simple License” or “Exclusive License” basicly according to the rights they provide. License Agreements are sui generis commutative contracts which provide continuous reciprocal liability between the parties. While the party which provides the license, assigns an immaterial right to the other party, the party granted with the license commits to pay the license fee. License Agreements can not only be terminated for the general reasons related to the other agreements, but also for special reasons granted under the Turkish Intellectual Property and Artistic Works Law No: 584.
