CMR sigortası

Abstract

İş bu tezde, Orijinal adı “Convention Relative au Contrat de Transport International de Marchandises par Route” olan ve CMR olarak kısaltılan, Türkçe karşılığı “Karayolu ile Uluslararası Eşya Taşınmasına İlişkin Konvansiyon” kapsamında taşıyıcının sorumluluğunu teminat altına alınan CMR Sigortası incelenmiş ve değerlendirilmiştir. Tezimizin ilk bölümünde, sigorta himayesi kavramından hareketle, 6102 sayılı Türk Ticaret Kanunu'nunda 1473üncü ve devamı maddelerde düzenlenen sorumluluk sigortalarına genel bakış ile kanunda ayrıca düzenlenmeyen, taşıyıcının kara, hava, deniz yoluyla yaptığı taşımalarda üstlendiği rizikoyu teminat altına alan taşıma sorumluluk sigortası üzerinde durulmuştur. İkinci bölümde, Karayolu ile Uluslararası Eşya Taşınmasına İlişkin Konvansiyon'un (Convention on the Contract for the İnternatıonal Carrıage of Goods by Road-CMR) doğuşu, kapsamı ve Türk Hukukundaki yeri açıklanarak, Konvansiyon hükümlerine göre yapılacak bir taşıma işinde taşıma sözleşmesi ile bu sözleşmesinin taraflarından hareketle; Kovansiyon hükümlerine göre taşıyıcının sorumluluğunu doğuran haller ve ortadan kaldıran haller ele alınmıştır. Üçüncü bölümde tezimizin temeli olan CMR Sigortası genel olarak açıklandıktan sonra, bu sigortaya uygulanacak hükümler ile CMR Sigortasının uygulama şartları tek tek sayılmıştır. Akabinde bu sigorta ilişkisinin tarafları ve sigortalanabilen menfaatin niteliği üzerinde durulmuştur. Bu bağlamda; CMR Sigortasının Sigorta Hukuku içindeki yeri, Türk Ticaret Kanunu kapsamında Sorumluluk sigortası ve taşıyıcının mali sorumluluk sigortası ile birlikte değerlendirilmiştir. Dördüncü ve son bölümde de tezimizin konusu olan CMR Sigortası Yargı kararları ışığında değerlendirilmiştir. Tezimiz genel değerlendirme ve sonuç bölümü ile tamamlanmıştır.

In this thesis , hereby, the CMR Insurance guaranteeing the responsibility of the carrier under the regulations of the CMR i.e. Convention on the Agreement on Inernational Carriage of Goods by road which's original name is “Convention Relative au Contrat de Transport International de Marchandises par Route” was examined. In the first section of our thesis, through the concept of the insurance protection, an overview of the liability insurance , which is regulated by law no. 6102, articles 1453rd and the contiuning articles of Turkish Commercial Law and carrying liability insurance guaranteeing the risks of land, air, sea transportation which the carrier has undertaken and which has not been regulated separately in the law, was pointed out. The second section focuses on the rise, the content and the place of the International Convention on the Carriage of Goods (CMR) by vii road in the Turkish Law. In accordance with the provisions of the transportation business regulated by the laws of the Convention ; the circumstances and conditions which both give rise to the responsibility of the carrier and which eliminates the responsibility of the carrier were examined. In the third section, after giving a brief explanation of the CMR Insurance which is the foundation of our thesis, we listed the applications of the provisions of this insurance and the CMR Insurance requirements individually. Then, we focused on the parties to the relationship and the quality of the commodities which can be insured. The place of CMR Insurance in Insurance Law, under the regulations of the Turkish Commercial Law, were evaluated with the ınsurance liability and the carrier’s responsibility insurance. The fourth and final chapter in the thesis, were evaluated in the light of the CMR insurance judicial decisions. At last; our thesis finalized with general summary and the conclusion part.
