Hukuk ve ideoloji

Abstract

Hukuk ideoloji ile ilişkili midir? Oldukça tartışmalı olan bu sorunun cevabını farklı ideolojilerin hukuka bakışına bakarak bulmak mümkündür. Bilindiği üzere modern devlet ile beraber toplumda var olan iktidar ilişkileri, ekonomik ve sosyal yaşam, hukuki düzen de değişmiş ve beraberinde birtakım yeni kavramlar ortaya çıkmıştır. Pozitif hukuk, hukukun üstünlüğü, insan hakları, hukukun evrenselliği gibi kavramlar bunlardan birkaçıdır. Bu kavramlara bakıldığında zihinlerde hukukun tarafsız olduğu, toplumda eşitliği sağlayan yegane mekanizma olduğu algısı oluşmaktadır. Peki hukuk, gerçekten insanların eşitliğini tesis eden, onların özgürleşmelerine yardımcı olan, her zaman mağdur olanın yanında olan haklar bütünü müdür? Bütün bunları cevaplamak kuşkusuz mümkün değildir. Ancak bu soruların cevabını ararken şüphesiz hukuk ve ideoloji arasındaki ilişkiyi göz ardı etmemek gerekecektir. Hukukun ideoloji ile ilişkisini anlayabilmek amacıyla öncelikle devletin ideolojik yönünü anlamak gerekmektedir ve bu bağlamda ulus devlet kurgusunu, bürokrasiyi ve beraberinde bireylerin hak ve özgürlüklerini sınırlandıran denetimi, mevcut ilişkilerin sürdürülmesi için oluşturulan rızaya dayalı hegemonyayı, eşitsizliklerin kaynağı olan sivil toplumu iyi anlamak gerekmektedir. Çünkü hukuk toplumsal ilişkilerde ideolojiye odaklı hareket etmekte ve bu süreçte devlet hukuku bir araç olarak görmekte ve kullanmaktadır. Bu sebeple yalnızca zora dayalı bir mekanizmadan ibaret olmayan devletin hukuktan etkin bir biçimde faydalandığını söylemek mümkündür. Bu bağlamda devletten yani siyasi iktidardan etkilenen hukukun tarafsız olamayacağı açıktır. Sistemin belli bir zümre lehine işlemesine büyük katkı sağlayan hukuk, tarihsel süreçte yeniden üretim sebebiyle yeni oluşumları desteklemiş, mevcut yapının devamlılığı için en temel mekanizmalardan biri olmuştur. Hukuk devleti, hukukun üstünlüğü, doğal hukuk, pozitif hukuk gibi kavramlarla, iktidar hukukla sınırlandırılmış ve birey eşit ve özgür hukuki bir özne olarak kabul edilmiştir. Böylelikle toplumdaki mevcut eşitsizliklerin ve sömürünün üzeri örtülmüş, eşitlik ve adalet adı altında eşitsizlik ve adaletsizlik gizlenmiş, diğer taraftan hak ve özgürlüklerin savunucusu olarak hukuk yüceltilmiştir. Oysa hukuk, egemen ideoloji ile uyumlu bir biçimde, bir hak tanımı yapmakta ve ona büyük bir değer yüklemektedir. Bireyin belli haklarla donatılarak hukuki bir özne olarak kabul görmesi, toplumsal eşitsizliklerin yeniden üretimine katkı sağlamaktadır. Bu sebeple hukuk, toplumsal ve ekonomik ilişkilerin sürdürülebilmesi için zorunlu ve olumlu bir unsur olarak tasvir edilmektedir

Is law related to ideology ? It is possible to find the answer of this question which is very controversial looking at the viewpoint of different ideologies. As known, the modern state with power relations in society, economic and social life and legal order has changed and at the same time some new concepts have emerged. Positive law, the rule of law, human rights, the universality of the law are just a few of them. When view to these concepts, it consists perception in mind as the only mechanism is the law that ensures equality in society and it is impartial. Is the law which ensures equality genuinely helping people who are emancipationed and victims of this body of rules? It is not possible to answer all of them. But when looking for answers of these questions, it needs not to ignore the relationship between law and ideology. It is necessary that understanding the ideological aspect of the state primarily to understand relations between law and ideology. In this context it is necessary to understand the fiction of nation state, bureaucracy and control which is limiting the right and liberties of individuals, consensual hegemony which is created to continue the available relations, civil society that is source of inequalities. Because the law act focusing the ideology in social relations and within this period the state look on the law as a means and use it. Therefore it is possible to say the state that is not mechanism based upon on force, use the law effectively. In this sense, it is obvious that law that is influenced from the state or the government, can not be impartial. The law that is contributing the system processes on behalf of certain class has supported the new formations for reproduction and has become one of the most basic mechanism for the continuity of current business in the historical process. The authority is limited by the law with such as the concept of rule of law, natural law, positive law and the individual has been recognized as an equal and free legal subject. Thus, inequality and exploitation that is existing in the society has been covered, inequality and injustice has hidden under the name of equality and justice, on the other hand the law has been glorified as advocate of rights and liberties. But the law that defines a right and attributes a meaning to it, accommodate with the dominant ideology. The acceptability of the individual as a legal subject that is endowed with certain rights contributes to reproduction of social inequality. Therefore the law is depicted as a necessary and favourable element for the sustainability of social and economic relations.
