Bu çalışmanın konusunu, "Tam iki tarafa borç yükleyen sözleşmelerde borçlunun temerrüdü" oluşturmaktadır. Borçlar Hukuku, temel borç ilişkilerine dayalı bir hukuk dalıdır. Borç ilişkilerinde borca aykırılığın özel bir türünü ise temerrüt oluşturmaktadır. Tam iki tarafa borç yükleyen sözleşmelerde karşılıklı bir borç ilişkisi söz konusu olduğundan sözleşmenin her iki tarafı için de temerrüt hükümleri işlerlik kazanmaktadır. Zira taraflar birbirinin hem borçlusu hem de alacaklısıdır. Tam iki tarafa borç yükleyen sözleşmelerde borçlunun temerrüdü genel hatları ile genel hükümlerde yer alan borçlunun temerrüdünün hüküm ve sonuçlarını da ihtiva etmektedir. Ancak sözleşmenin karşılıklı olması nedeniyle genel hükümlerden farklı şart ve sonuçları da vardır. Çalışmanın birinci bölümünde tam iki tarafa borç yükleyen sözleşmelerin özellikleri, ikinci bölümünde temerrüdün çeşitleri ve şartları, üçüncü bölümünde ise hüküm ve sonuçları ele alınmıştır.
The theme of this study is "The default of debts in contracts that lend to both sides". Debt Law is a law based on basic debt relations. In the case of debt-related debts, there is a special case of delinquency. Delinquency provisions become operative on both sides of the contract, as there is a mutual debt relationship in contracts that lend to both sides. Because the parties are both indebted and creditor of each other. The contracts that lend to the two parties include the general outlines of the debts and the provisions and consequences of the defaults of the debts in the general provisions. However, because of the reciprocal nature of the contract, there are also different terms and conclusions from the general provisions. In the first part of the study, the features of the contracts that owe to the two sides, in the second part, the types and conditions of the default, and in the third part the provisions and results are discussed.
