Gelişen ve değişen toplumlara paralel olarak, insan ihtiyaçları, ticaret ilişkileri gibi toplumu ayakta tutan kuralların ortaya çıkması veya değişmesi ihtiyaç dâhilindedir. İnsanların devleti oluşturduktan sonra, devletin güvencesi altında malvarlıklarının korunması, devlet olmanın bir gereğidir. Devlet bunu yaparken, haksız eylemi cezalandırdığı gibi tazmin yolu ile devletin bireyi olan kişilerin hak ve menfaatlerini koruyabilmektedir. Ayrıca devlet, bu tarz eylemlerin, kanunla önceden ilanı yoluna giderek şahısları uyarmakta ve davranışlarında daha dikkatli olmasını istemektedir. Güveni kötüye kullanma suçu, kanun ile kişilerin mülkiyet haklarının yanında, güven duygularının ve zilyetliklerinin de devletçe korunduğu suç tipidir. Biz bu tezimizde güveni kötüye kullanma suçunun kanunda düzenleniş biçimine, suçun unsurlarına ve korunan hukuki yarara değindik. Bu bağlamda, sonuç bölümde eksik gördüğümüz hususlara ve tartışmalı konulara değinmeye çalıştık. Tez üç bölümden oluşmaktadır. Birinci bölümde güveni kötüye kullanma kavramı, suçun eski ve yeni ceza kanunumuzdaki yeri, suçun konusu, suçla korunan hukuksal yarar, suçun faili ve mağduru olabilecek kişiler, suçun ön koşulu olarak zilyetliğin devri, suçun unsurları, özel görünüş biçimleri, cezaya etki eden haller ayrı başlıklar altında incelemiştir. İkinci bölümde ise, suçun nitelikli halleri ayrı başlıklar halinde incelenmiştir. Bunlarla birlikte suçun daha iyi anlaşılması ve ayırt edilebilmesi için, nitelik itibari ile benzer suçlar ile karşılaştırması yapılarak, farklılıklar ayrı başlıklar altında incelenip anlatılmaya çalışılmıştır. Üçüncü bölümde ise, takibat hükümleri incelenmiştir. Son olarak ise konuya ilişkin olarak sonuç başlığında eleştirilerimiz ve önerilerimiz sunulmaya çalışılmıştır.
Similar to the development and change in societies, the change in human needs and trade relations leads to change or emergence of rules that keep society alive. After creating the state, protection of assets under the government's assurance is a requirement of being a state. In doing so, as the state punishes unjust action it protects the rights and interests of the individuals through compensation. Moreover, by declaring the law, the state warns individuals that unjust actions constitute crime and wants them to be more careful in their behaviors. The crime of breach of trust is the type of crime for which the sentiments of trust and possessions as well as the property rights of persons are protected by the state by law. In this thesis we addressed the form of regulation of the crime of breach of trust, the elements of the crime and the protected legal benefit. In this context, in the conclusion section, we have tried to address controversial issues and issues that we think is missing. The thesis consists of three parts. In the first chapter, the concept of abuse of trust, the place of the crime in the old and new criminal law, the subject of the crime, the legal benefit protected by the crime, the perpetrator of the crime, the criminal elements, special appearance forms. In the second part, the cases of the criminal nature are examined under separate headings. in order to be able to better understand and distinguish the crime together with the similar crimes in terms of quality, the differences have been examined under different headings and tried to be explained. In the third chapter, the provisions of the prosecution were examined. Finally, our criticisms and suggestions are presented in the conclusion.
