4054 sayılı Rekabetin Korunması Hakkında Kanun’un (bundan sonra Kanun olarak anılacaktır) 20. maddesiyle Anayasa’nın 167. maddesi uyarınca Rekabet Kurumu kurulmuş ve rekabet ortamının tesisi, korunması ve Kanun’un uygulanmasının izlenmesi ile görevlendirilmiştir. Rekabet Kurumu’na, rekabet düzeninin sağlanması ve korunması görevini ifa edebilmesi için geniş düzenleme ve denetleme yetkileri tanınmıştır. Kanun’un 9/4. maddesinde düzenlenen “Geçici Tedbir”, 14. maddesinde düzenlenen “Bilgi İsteme” ve 15. maddesinde düzenlenen “Yerinde İnceleme” kararları, Rekabet Kurulu’nun denetim yetkisini kullanmasının en etkin araçlarıdır. Kurul bu yetkilerini (geçici tedbir kararı hariç olmak üzere), sadece “İnceleme ve Araştırma Usulü” başlığı altında düzenlenen faaliyetleri yürütürken değil; muafiyet, birleşme veya devralma, işlemlerine izin verilmesi ya da menfi tespit gibi diğer incelemelerini yürütürken de kullanabilir. Kurul’un yukarıda anılan kararlarla kullanacağı denetim yetkisinin teminatını, Kanun’un 16 ve 17. maddelerinde düzenlenen idari para cezaları oluşturur.
At the Article 20 of the “The Act on the Protection of Competition” numbered 4054 (here and after called “Act”), The Competition Authority has been established with respect to the Article 167 of the Turkish Constitution and the Competition Author- ity has been assigned to observe competition practices and ensure the application of the Act. In order to conduct the regulation of the competition, the Competition Board has been empowered with the broad regulatory and supervisory powers. The decisions of the “Interim Measures” (Art. 9/4), “Request for Information” (Art. 14) and “On-the-Spot Inspection” (Art. 15), which have regulated at the Act, are the most effective powers performing duly protection of competition. Except the interim measure decision, these supervisory powers are not restricted to the “Procedure in Examinations and Inquiries”, but also be used in the process of taking decisions on exemption, negative clearance and etc. as well. Furthermore the supervisory powers of the Competition Board are secured by the administrative fines which are set forth at articles 16 and 17 of the Act.
