Bu çalışmada istenmeyen ticarî elektronik iletilerin Avrupa Birliği ve Türk hukukundaki düzenlenişi ele alınmıştır. Konu incelenirken öncelikle spam ve istenmeyen ticarî elektronik ileti kavramlarına değinilmiş, bu iki kavram arasındaki fark ortaya konulmaya çalışılmıştır. Sonrasında ticari elektronik iletilerin gönderilmesi konusunda kabul edilen iki sisteme, izin ve ret sistemlerine değinilmiş, bu sistemlerin olumlu ve olumsuz yönlerinden söz edilmiştir. Ardından, konunun Türk hukuk düzenlemelerine de kaynaklık teşkil eden Avrupa Birliği direktiflerindeki durumuna yer verilmiştir. Daha sonra ticarî elektronik iletilerin gönderilmesi konusundaki Türk hukuk düzenlemeleri ele alınmıştır. Bu bağlamda 6563 sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanunun ve Ticari İletişim ve Ticari Elektronik İletilere İlişkin Yönetmelik'in konuya ilişkin hükümleri incelenmiştir. Konuyla ilgili hükümler incelenirken, özellikle Elektronik Ticaretin Düzenlenmesi Hakkında Kanun ile Avrupa Birliği direktiflerinin benzer ve farklı yönleri karşılaştırılarak ele alınmıştır. İstenmeyen ticarî elektronik iletilerin gönderilmesi konusunda bazı değişiklik önerilerine özellikle sonuç kısmında yer verilmiştir.
In this study, the arrangement of unsolicited commercial electronic communication in European Union and Turkish domestic law has been addressed. We begin our study with defining the concepts of spam and unsolicited commercial electronic communication, and then differences between two concepts have been revealed. Next to this, we mention two systems which are opt-out and opt-in systems that can be adopted about sending of unsolicited commercial electronic messages. We state the positive and negative aspects of these systems. Following this, the European Union directives, which constitute the source of the Turkish legislative regulations, have been referred to. Later, the Turkish legislative regulations on sending of commercial electronic messages have been analyzed. In this context, we examine the legal provisions concerning the Law No. 6563 on the Regulation of Electronic Commerce and the by-law on the Commercial Communication and the Commercial Electronic Messages. While examining the legal provisions relating to the subject, in particular we point out the differences and similarities between European Union Directives and the Law No. 6563 on the Regulation of Electronic Commerce by comparing them. We give place to some amendment proposals in the matter of sending of unsolicited commercial electronic messages particularly in conclusion.
