Yeni Türk Ticaret Kanunu’na göre asliye ticaret mahkemeleri

Abstract

Eski Türk Ticaret Kanunu döneminde, asliye ticaret mahkemeleri, asliye hukuk mahkemelerinin ticari davalara bakan dairesi konumunda idi. Ancak, yeni Türk Ticaret Kanunu’nda, asliye ticaret mahkemeleri, ticari davalara ve ticari nitelikli çekişmesiz yargı işlerine bakmakla görevli ihtisas mahkemesi olarak düzenlenmiştir. Bu düzenlemelerde, asliye ticaret mahkemelerinin görev alanı genişletilmiştir. Asliye ticaret mahkemeleri ile diğer mahkemeler arasındaki ilişkinin hukuki niteliği değiştirilmiştir. Çalışmada asliye ticaret mahkemelerinin niteliği, yapısı, görev alanı ve diğer mahkemelerle ilişkisi incelenmiştir. Asliye ticaret mahkemelerinde görev yapan hâkimlerin sayısı ve niteliği, olması gereken hukuk açısından ele alınmıştır.

According to the previous Turkish Commercial Code, commercial court of first instance had been established as a chamber of civil court of first instance. However, the new Turkish Commercial Code has now accepted commercial courts of first instance as special courts which hear commercial cases and commercial matters of non-contentious jurisdiction. Thus, the new Turkish Commercial Code enlarged the coverage of the competence of commercial courts. Now, the legal relationship between the commercial courts of first instance and the civil courts of first instance is regulated differently. In this study the characteristics, structure, coverage of the competence and the relation of the commercial court of first instance to the other courts are analyzed and discussed. The number and qualification of judges in commercial courts are dealt with respect to de lege ferenda.
