Destekten yoksun kalma tazminatı ve hukuki sonuçları

Abstract

Destekten yoksun kalma tazminatı zarar verici fiil sonucu ölüm olayının meydana gelmesi durumunda, ölen kişinin hayattayken yardımda bulunduğu veya ileride bulunacağı kişilerin mal varlıklarına yönelik meydana gelen zararların giderilmesini amaçlamaktadır. Bu tazminatın gündeme gelebilmesi için öncelikle tazminat talep eden kişi ile ölen kişi arasındaki destek ilişkisi tespit edilmelidir. Destek ilişkisinden söz edebilmek için düzenli ve devamlı yardımın mevcut olması veya ileride bu yardımların gerçekleşeceğinin kuvvetle muhtemel olması gerekir. Destekten yoksun kalma tazminatının özelliklerini bağımsız nitelik taşıması, mal varlığı zararı şeklinde gözükmesi ve yansıma zarar teşkil etmesi olarak sıralayabiliriz. Düzenli ve devamlı bir yardımın söz konusu olmasının yanı sıra, desteğin bakım gücüne sahip olduğunun ve destek görenin de bakım ihtiyacı içinde olduğunun kanıtlanması gerekir. Destekten yoksun kalma tazminatındaki zararın hesaplanabilmesi için öncelikle desteğin tazminata esas alınacak geliri belirlenir ve tazminat hukukunun genel prensipleri ışığında zarardan ve tazminattan indirilmesi gereken durumlar göz önünde tutulur. Son olarak belirlenen tazminat faiziyle birlikte irat veya sermaye şeklinde borçludan tazmin edilir.Hazırlanan bu çalışmada konu ile ilgili doktrindeki tartışmalara yer verilmiş olup, Yargıtay kararlarıyla desteklenmiştir.

In this study which is prepared as a Master's thesis, the subject of deprivation of support is examined. The purpose of compansantion for loss of support is to compensate for damages caused by the death of the deceased person in the event of death or damage to the assets of those who are in vain or in the future. In order for this compensation to come to an end, the support relationship between the claimant and the deceased must first be determined. There is a strong possibility that there will be regular and ongoing assistance in order to mention the support relationship or that these benefits will be realized in the future. In addition to regular and ongoing support, it must be proven that the support has the maintenance power and that the support person is also in need of care. In order to be able to calculate the loss in subsidized compensation, the income to be based on the compensation of the support is first determined and the situations that need to be reduced in the light of the general principles of the compensation law are taken into consideration. It is indemnified with debt or interest in the form of income or capital together with the last indemnity interest.In this study, the discussions in the doctrine about the subject were given and they were supported by the Supreme Court decisions.
