Anayasanın varlığını ve otoritesini korumak için devletlerin, karşılaşılabilecek derhal hareket isteyen beklenmedik genel tehlike durumlarına karşın bazı ayrıcalıklı yetkilerle önceden donatılmış olması gerekir. Nitekim bugün karşılaştırmalı hukuka bakıldığında hemen hemen demokratik hukuk devleti olarak addedilebilecek bütün ülkelerin hukuk sistemlerinde, devlete bu ayrıcalıklı yetkileri sağlayan olağanüstü hal rejiminin ele alındığı görülmektedir. Bu rejime başvuru neticesinde temel hak ve özgürlüklere normalden daha öte bir seviyede müdahale edilebilmesi ise rejimin doğurduğu doğal bir sonuç olup, Türkiye Cumhuriyeti Devleti Anayasasında da bu doğal sonuca yer verilmiştir. Bu çalışmanın amacı ise Türkiye'nin olağanüstü hal dönemlerinde temel hak ve özgürlüklerin durdurulma sistemini göstermek ve yapılan son Anayasa değişikliklerinin bu sisteme yansımalarını ortaya koymaktır. In case of unexpected general danger that requires immediate action to preserve the existence and authority of the constitution, the governments are supposed to be equipped by some privileged authorization. As a matter of fact, when we consider comparative law, today in the judicial system of almost all of the countries which are regarded as democratic state of law, it is seen that the state of emergency regime which provides these privileged authorization to the government is handled. As a result of the application to this regime, the intervention of fundamental rights and freedoms at a higher level than normal is a natural consequence of the regime and it is given place to this natural result in the constitution of the state of the Republic of Turkey. The aim of this study is to show the system of suspension of fundamental rights and freedoms in Turkey's state of emergency and the reflection of the recent constitutional amendments to this system.
