Yapı malikinin tazminat sorumluluğu

Abstract

Geçmişten günümüze, sorumluluk hukukunda ortaya çıkan en önemli sorun, üçüncü bir kişinin haksız fiili neticesinde bir zarar doğması halinde, meydana gelen zarardan kimin sorumlu olacağı olmuştur. Sorumluluk hukukunun temelini kusura dayanan sorumluluk halleri oluşturmuş olup herkesin meydana getirdiği fiil sebebiyle ortaya çıkan zarardan, kusuru oranında, kısmen veya tamamen sorumlu olacağı düşüncesi sorumluluk hukukuna hâkim olmuştur. Zamanla toplumsal kuralların ve teamüllerin değişmesiyle birlikte kusura dayanan sorumluluk halleri yetersiz kalmış, herkesin kusurlu hareketi neticesinde meydana gelen zarardan sorumlu olacağı ilkesine birtakım istisnalar getirilmiştir. Türk Borçlar Kanunu'nun 69'uncu maddesinde düzenlenen bina ve yapı eseri malikinin sorumluluğu da, kusur esasına dayanan sorumluluk hallerinden ayrılarak, meydana gelen zarardan ilgili kişilerin sorumlu olması için kusur şartı aramayan kusur sorumluluğu ilkesinin istisnalarından birisidir. Çalışmamızda bir kusursuz sorumluluk hali olan bina ve yapı eseri malikinin sorumluluğunun hukukî niteliği, dayandığı esaslar ve benzer sorumluluk hallerinden farkları ortaya konulduktan sonra, bina ve yapı eseri kavramları ile birlikte sorumluluğun ortaya çıkması için gerekli olan şartlar ele alınmıştır. Çalışmamızın devamında ise, Türk Borçlar Kanunu'nun 69'uncu maddesi kapsamında kimlerin zarardan sorumlu olduğu ve sorumluluğun hükümleri incelenmiştir. Doktrindeki görüşlere ve Yargıtay içtihatlarına da yer verilerek çalışmamız tamamlanmıştır.

From the past to the present, the most important problem that arises in liability law has been who will be responsible for the damages that occur as a result of a tortious act of a third person. Liability law has been based on the basis of the defect liability statuses. Also, the idea that everyone will be partially or entirely responsible for the damage arising from their act dominates this field of law. Due to the change of social rules and precedents over time, the liability statuses based on defect have remained inadequate and some exemptions have been introduced to the principle that everyone would be responsible for the damage caused by the wrongful act. The responsibility of the building and property owner, which is regulated in Article 69 of the Turkish Code of Obligations, is also one of the exceptions of the defect liability principle, which does not require fault in order to be responsible for the damage. In the present study, after discussing the legal characteristic of building and property owner responsibility, which is an absolute liability, its basics and the differences from similar responsibility situations; the necessary conditions for the emergence of responsibility together with the concept of building and property owner had been handled. Later on of our paper, within the Article 69 of Turkish Code of Obligations, it has been analyzed who is responsible for the damage and the provisions of the liability. Our work has been completed by addressing the opinions in the doctrine and the case law of the Supreme Court.
