Avrupa İnsan Hakları Mahkemesi Kararlarının İcrası, Avrupa İnsan Hakları Sözleşmesine taraf devletlerin Avrupa İnsan Hakları Mahkemesi tarafından verilen ihlal kararları doğrultusunda iç hukuklarını ve uygulamalarını Sözleşmeye uygun hale getirmesine yol açan en önemli araçlardan biridir. Bakanlar Komitesi tarafından Avrupa İnsan Hakları Mahkemesi Kararlarının taraf devletlerce uygulanıp uygulanmadığı denetlenir. Taraf Devletler Bakanlar Komitesine AİHM kararlarının icrası bağlamında bilgi sunmak zorundadır. Bu sayede taraf devlet kararın icrası bağlamında başvuranın ihlal durumunu telafi edecek ve ihlale neden olan hususları düzelterek ilerde gerçekleşecek benzer ihlallerin önüne geçmek için çalışma yapacaktır. Avrupa İnsan Hakları Mahkemesi, bugüne kadar Türkiye hakkında birçok ihlal kararı vermiştir. Bu sebeple, Avrupa İnsan Hakları Mahkemesi kararlarının yerine getirilmesiyle iç hukukumuzda önemli gelişmeler kaydedilmiştir.
The execution of the judgments of the European Court of Human Rights is one of the most important means by which States parties to the European Convention on Human Rights shall bring their domestic laws and practices into conformity with the Convention in accordance with the decisions of violation given by the European Court of Human Rights. The Committee of Ministers supervises the execution of the decisions of the European Court of Human Rights by the States Parties. States parties are obliged to provide information to the Committee of Ministers in the context of the execution of European Court of Human Rights judgments. In this way, the State party will compensate the applicant for the violation in the context of the execution of the decision and will work to prevent further violations by correcting the causes of the violation. European Court of Human Rights gave a lot of violations about Turkey until today. For this reason, important developments have been achieved in our domestic law with the execution of the judgments of the European Court of Human Rights.
