Organ veya doku nakli, yaşayan veya ölmüş bir kişiden alınan organ (organın tamamı olabileceği gibi, bir parçası
da olabilir) veya dokunun, tedavi amacı güden bir tıbbi müdahaleyle başka bir kişinin vücuduna yerleştirilmesi
olarak tanımlanabilir. Türk Medeni Kanunu’nun 23/3. maddesinde, açıkça organ veya doku terimleri kullanılmamış
olmakla birlikte, “Yazılı rıza üzerine insan kökenli biyolojik maddelerin alınması, aşılanması ve nakli mümkündür.”
ifadesiyle, kişiliğin korunması açısından organ ve doku nakline izin verilmiştir. Maddenin devamında yer verilen,
“Ancak, biyolojik madde verme borcu altına girmiş olandan edimini yerine getirmesi istenemez; maddi ve manevi
tazminat isteminde bulunulamaz.” kuralıyla, organ veya doku verme borcu altına giren kişinin sonradan caymasının
önünde tazminat engelinin olmaması amaçlanmıştır.
Organ and tissue transplantation can be defined as the implantation of an organ (or may be part of the whole
organ) from a living or dead person, or implantation of tissue into another person's body through a medical
intervention for therapeutic purposes. In Article 23/3 of the Turkish Civil Code, although organ or tissue terms are
not explicitly used, organ and tissue transplantation is allowed for the protection of personality with the expression
“It is possible to receive, vaccinate and transplant biological substances of human origin upon written consent.”
Through the added explanation in the continuation of the article, “However, it cannot be asked to fulfill the act of
the one who has come under the obligation to give biological material; it cannot be claimed for pecuniary and nonpecuniary damages.” and is intended that there is no obstacle to compensation for the person who has committed
to giving organs or tissues then reclaims his consent.
