Bu çalışmada, Cumhuriyet savcısının hukuk davalarındaki görevleri incelenmiştir. Çalışmada, öncelikle, Cumhuriyet savcısının, Ceza Yargılaması Hukuku'ndaki yeri, görev ve yetkileri, bağımsız ve tarafsız olup olmadığı sorunu öğretideki farklı görüşlere de değinilerek irdelenmiştir. Ayrıca, Cumhuriyet başsavcılığı teşkilatı, yapısı ve savcılık kurumunun tarihsel gelişimine ilişkin olarak da genel bilgilere yer verilmiştir. İkinci bölümde, Cumhuriyet savcısının hukuk davalarına katılması ve bu davalardaki işlevi yürürlükteki mevzuat ve Medeni Yargılama Hukuku'nun genel prensipleri çerçevesinde incelenmiştir. Bu değerlendirmeler ışığında, üçüncü bölümde de, Cumhuriyet savcısının katıldığı davalar tek tek ele alınacak, davaların açılmasında, açılmış olan davaya katılmada ve kanun yollarında Cumhuriyet savcısının işlevi belirlenmeye çalışılmıştır. Son olarak ise, ilk derece mahkemeleri tarafından kesin olarak verilen hükümler ve Yargıtay'ca incelenmeksizin kesinleşen hükümler aleyhine Yargıtay Cumhuriyet Başsavcısı'nın başvurduğu kanun yararına temyiz kanun yolu ve kanun yararına bozma kararının hukuki sonuçları incelenmiştir.
In this work, the tasks of public prosecutors in private law are examined.During the first part of examination, the role, task and authority of public prosecutor in Criminal-Law is worked on and the problem of being independent and objective is questioned referring to the other views. Also, there is some basic information about the structure and chronological process of prosecution foundation and the organisation of public prosecutors.In the second part, public prosecutors? attandance to the civil cases and the roles they take in these cases are examined within the perspective of operating legislations and civil law. In the third part supported by the former parts, it is aimed to determine the public prosecutors? role in new cases, their attandance to these newly-started cases and legal remedies by examining all the cases one by one which they took part before.For the last part of examination, the legal conclusions of judgement notwithstanding the verdict and the legal remedy of the public prosecutor?s judgement notwithstanding the verdict are examined against the definite verdicts sentenced by court of original jurisdiction and verdicts which become definite without being examined by Supreme Court.
