Türk Ceza Hukukunda hakaret suçu

Abstract

Hakaret suçu, kişisel onur ve saygınlığı korumak amacındadır. Bu sebeple 5237 sayılı Türk Ceza Kanunu'nun " Kişilere Karşı Suçlar" adlı ikinci kısmının sekizinci bölümünde "Şerefe Karşı Suçlar" olarak 125 ve devamı maddelerinde düzenlenmiştir. 5237 sayılı Türk Ceza Kanunu hakaret suçu bakımından 765 sayılı Türk Ceza Kanunu'ndan önemli farklılıklara sahiptir. Bu farklılıklardan birisi de "hakaret" ve "sövme" ayrımının ortadan kalkmasıdır. Demokratik hukuk sistemlerinde kişiler ifade hürriyetine sahiptir. Eleştiri ve hiciv de bu kapsamdadır. Ancak ifade hürriyetinin de bir sınırı vardır. Bu sebeple ifade hürriyeti ve hakaret suçu arasındaki denge birçok Avrupa İnsan Hakları Mankemesi kararlarının temasını oluşturmaktadır.
