Uyuşturucu veya uyarıcı madde imal ve ticareti suçu

Abstract

Çalışmamızın konusunu Türk Ceza Kanunu'nda düzenlenen uyuşturucu veya uyarıcı madde imal ve ticareti suçu (TCK m.188) oluşturmaktadır. Uyuşturucu ve uyarıcı madde bağımlılığı insan ve toplum sağlığı üzerindeki olumsuz etkileri nedeniyle önemlidir. Konu ile ilgili olarak mevzuatımızda Türk Ceza Kanununda ve özel kanunlarda yapılan düzenlemeler ile gerekli denetimler yapılmaktadır. Uyuşturucu veya uyarıcı madde imal ve ticareti suçları için ağır yaptırımlar öngörülmüştür. Uyuşturucu ve uyarıcı madde kullanımının artarak yaygınlaşmasını önlemek amacıyla söz konusu maddelerin imal ve ticaretinin denetlenmesi önemlidir. İlk bölümde uyuşturucu veya uyarıcı madde kavramı, tanımı, çeşitleri incelenmekte, ilgili uluslararası sözleşmeler, örgütler ve iç hukukumuzda yer alan düzenlemeye değinilmektedir. İkinci bölümde uyuşturucu veya uyarıcı madde imal ve ticareti suçu kapsamında, hukuki konu, maddi konu, suçun faili ve mağduru ve suçun kanuni unsuru, maddi unsuru, manevi unsuru ve hukuka aykırılık unsuru incelenmiştir. Üçüncü bölümde suçun özel görünüş biçimleri, suçun nitelikli halleri, yaptırım, etkin pişmanlık, zamanaşımı, soruşturma ve kovuşturma konuları incelenmiştir. Sonuç kısmında çalışmamızda yer alan konular genel olarak özetlenmiş ve değerlendirilmiştir.

The subject of our study constitutes the manufacure and trafficking of drugs or psychotropic substances in the Turkish Penal Code. The dependence of drugs and stimulants is important because of its negative impact on human and public health. Our legistlation on the subject is carried out with the arrengements and the necessary controls in the Turkish Penal Code and in private law. Severe sanctions are envigased for the manifactur and traffickings of drugs or psychotropic substances. In order to prevent the increasing spread of the use of drugs and stimulants, it is important to check the manufactur and trade of these substances. In the first part, the concept, the definition and varieties of drugs or psychotropic substances are examined. Relevant international conventions,organisations and the regulatıons found in our inner law are also discussed. In the second part, within the manufacture and trafficking of narcotics and psychotropic substances, legal issues, the prepetrator, victims and legal elements of the crime, moral elements of crime, elements of unlawfulness are investigated. In the third part special appearance forms of crime, qualified forms of crime, effective regret, timeout and investigation and prosucetion subjects are also investigated. In general the subjects are evaluated and summarized at the end of our study.
