Motorlu taşıtlar sektöründe rekabeti sınırlayan anlaşmalar (2005/4 sayılı grup muafiyeti tebliği çerçevesinde bir inceleme)

Abstract

İşbu çalışmada, motorlu taşıtlar sektöründe rekabeti sınırlayıcı anlaşmalar, Rekabet Kurulu’nun 2005/4 sayılı Motorlu taşıtlar Sektöründeki Dikey anlaşmalar ve Uyumlu Eylemlere ilişkin Grup Muafiyeti Tebliği çerçevesinde incelenmiştir. 2005/4 sayılı Tebliğ ve bu Tebliğ öncesinde yürürlükte olan 1998/3 sayılı Tebliğ, Kurul’un sektöre yönelik olarak muafiyet verdiği ilk grup muafiyeti Tebliği’dir. Çalışmamızın ilk bölümünde, motorlu taşıtlar sektörü, bu sektörde faaliyet gösteren kişiler, dağıtım sistemleri ve ekonomik durum açısından genel olarak incelenmiştir. Bu çerçevede özellikle, sektör içinde yer alan temel kişi ve kavramlar ile 2005/4 sayılı Tebliğ ile getirilen niteliksel ve niceliksel seçici dağıtım sistemleri üzerinde durulmuştur. İkinci bölümde, rekabetin sınırlanması kavramından başlanarak, rekabete aykırı anlaşmalar ve bu anlaşmaların 4054 sayılı Kanun’un 4. Maddesindeki yasaktan grup olarak muaf tutulmasının Şartları belirlenmiştir. Bu çerçevede, muafiyet sistemi anlatıldıktan sonra, motorlu taşıt sektöründeki grup muafiyeti düzenlemeleri ele alınmıştır. Üçüncü ve son bölümde, 2005/4 sayılı Tebliğ’deki muafiyetten yararlanılmasının genel Şartları ile ağır sınırlamalar ve özel hükümler tek tek incelenmiştir.

In this thesis, the agreements limiting competition in the motor vehicle sector have been examined within the framework set by the General Grounds For The Block Exemption Communiqué On Vertical Agreements and Concerted Practices In The Motor Vehicle Sector (No:2005/4). This communiqué (also the previous communiqué no:1998/3) is the first block exemption communiqué issued by Competition Board for a specific sector. In the first section of our thesis, the meaning of the motor vehicle, the persons participating in this sector, the distribution systems, the present economic vii situation in the motor vehicle sector in Turkey has been examined. Within this scope, especially, we have dwelt upon the basic actors and concepts in the motor vehicle sector and the qualitative and quantitative selective systems regulated in the communiqué no 2005/4. In the second section, the agreements limiting competition and the conditions in order to be exempted from the prohibition regulated in Article 4 of Law No 4054 has been examined by starting from the explanation of the meaning of competition. Within this scope, we have explained the exemption system set by communiqué no:2005/4 and all the previous regulations in the motor vehicle sector. In the third and the last section, the general conditions, the hardcore restrictions and special provisions regulated in the Communiqué No:2005/4 have been examined one by one.
