Abstract

Hukuksal işlemlerin en önemli unsurlarından olan irade ve açıklamasının bir birine uygunluğu, işlemin geçerliliğini doğrudan etkilemektedir. Bu bağlamda irade ve açıklamasının bir birine uygunluğu, işlemin geçerli bir biçimde kurulmasında varlığı zorunlu olan bir koşuldur. İşte muvazaada irade ve açıklama arasında irade sahibi ve karşı tarafça bilerek meydana getirilen bir uygunsuzluk durumu söz konusudur. Muvazaanın konusunu oluşturan hukuksal işlem hüküm ve sonuçlarını doğurmamaktadır. Bu durum özellikle taşınmaz mülkiyetinin devri amacı güden işlemlerde özellik göstermektedir. Taşınmaz mülkiyetinin devri amacı güden görünürdeki işlem tarafların gerçek iradelerine uymaması, gizli işlem de resmi Şekle aykırı olması nedeniyle geçersizdir.

Compatibility of the will and its explanation, one of the most important components of the legal processes and transactions, directly affect the validity of the transaction. This situation is seen especially in the transactions which are aimed at transferring an immovable property and assets. That the transaction aimed at transferring an immovable property does not comply with the actual will of the parties is invalid due to the fact that the secret transaction is against the formal procedure.
